Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Ticketeria mobile application ("App"), you certify that you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the App. By tapping “I Agree” or using the App, you confirm:

  • You are at least 16 years old, or, if younger, you have obtained verifiable parental consent as required by applicable law (e.g., COPPA for users under 13 in the U.S., GDPR for users under 13–16 in the EU, or DPDP for users under 18 in India).

  • You will comply with these Terms and all applicable local, state, national, and international laws, including but not limited to GDPR, CCPA, CPRA, LGPD, PIPL, APPI, POPIA, and DPDP.

  • You acknowledge that violations may result in account suspension, termination, or reporting to authorities.
     

2. Description of Service

Ticketeria is a mobile application that enables users to:

  • Capture and store images of tickets (e.g., event, transit, or travel tickets).

  • Extract event information using artificial intelligence (AI) powered by third-party services (e.g., OpenAI).

  • Organize and manage ticket collections.

  • Share ticket information with others, subject to privacy settings.

The App is provided for personal, non-commercial use only unless otherwise authorized.
 

3. User Accounts
 

3.1 Account Creation

  • You must provide accurate, complete, and current information during registration.

  • You must be at least 13 years old to create an account without parental consent, unless a higher age is required by local law (e.g., 16 under GDPR in some EU countries, 18 under DPDP in India).

  • For users under the applicable age threshold, verifiable parental consent is required per COPPA, GDPR, LGPD, PIPL, or DPDP.

  • One account per person; shared or duplicate accounts are prohibited.

  • You are responsible for maintaining the confidentiality of your account credentials.
     

3.2 Account Security

  • You are solely responsible for all activities under your account.

  • Use strong, unique passwords and enable device security features (e.g., biometric authentication).

  • Do not share login credentials with others.

  • Notify us immediately at support@ticketeria.co of any unauthorized access or security breach.
     

4. Acceptable Use
 

4.1 Permitted Uses

You may:

  • Use the App for personal, non-commercial purposes.

  • Capture images of tickets you legally own or have permission to store.

  • Share ticket information with others, provided it complies with these Terms and applicable laws.

  • Provide feedback to improve the App.
     

4.2 Prohibited Uses

You may not:

  • Upload images or content that violate U.S., EU, or international laws, including but not limited to 18 U.S.C. § 2256 (CSAM), DSA (Digital Services Act), or local equivalents.

  • Upload images containing:

    • Child Sexual Abuse Material (CSAM) or explicit content.

    • Violent, terroristic, hateful, or abusive material.

    • Content flagged as “Likely” or “Very Likely” by Google Cloud Vision SafeSearch API for:

      • Adult content

      • Violence

      • Racy material

      • Medical content

      • Spoof or misleading content

  • Violate data protection laws, including GDPR, CCPA, CPRA, LGPD, PIPL, APPI, POPIA, or DPDP, by uploading personal data without consent.

  • Capture images of tickets belonging to others without explicit permission.

  • Use the App for illegal purposes, including fraud or misrepresentation.

  • Attempt to reverse engineer, hack, or interfere with the App’s functionality.

  • Upload malicious code, viruses, or harmful software.

  • Infringe intellectual property rights (e.g., copyrighted ticket designs).

Violations may result in immediate account suspension, content removal, and reporting to relevant authorities (e.g., FTC, DPA, or law enforcement).
 

5. Intellectual Property
 

5.1 Your Content

  • You retain ownership of ticket images and other content you upload.

  • By uploading images, you grant Ticketeria a non-exclusive, worldwide, royalty-free license to process, store, and analyze your images for App functionality (e.g., AI extraction of ticket details).

  • You are responsible for ensuring you have the legal right to upload and share content.

  • Ticketeria does not claim ownership of your personal ticket information or images.
     

5.2 Our Content

  • The App, its features, logos, and trademarks are owned by Ticketeria or its licensors.

  • You may not copy, modify, distribute, or reproduce the App or its content without prior written consent.

  • AI-generated summaries or extracted ticket data are provided “as-is” without warranties.
     

6. AI Processing and Accuracy
 

6.1 AI Services

  • The App uses third-party AI services (e.g., OpenAI) to analyze ticket images and extract information.

  • AI analysis is automated and may contain errors or inaccuracies.

  • You are responsible for verifying the accuracy of extracted information (e.g., event dates, times).

  • Ticketeria is not liable for errors in AI interpretation or processing.
     

6.2 Data Processing

  • Ticket images are temporarily processed by AI services and stored securely per our Privacy Policy.

  • Processing times vary based on image quality, complexity, and server availability.

  • Some images may not be suitable for AI analysis (e.g., blurry or low-resolution images).

  • We implement data minimization principles per GDPR, CCPA, and other laws to limit unnecessary data retention.
     

7. Privacy and Data Protection
 

7.1 Data Collection

  • We collect only the data necessary to provide App services, including account details, ticket images, and usage data.

  • For children under 13 (U.S.), 13–16 (EU, depending on country), or 18 (India), verifiable parental consent is required before collecting or processing data, per COPPA, GDPR, or DPDP.

  • Your privacy is governed by our Privacy Policy, available in the App.

  • You may request data access, correction, or deletion at support@ticketeria.co, subject to legal requirements.
     

7.2 Third-Party Services

  • We use Firebase (Google) for backend services and OpenAI for AI processing.

  • Third-party services are subject to their own privacy policies, which we encourage you to review.

  • Ticketeria is not responsible for third-party data practices but ensures compliance with GDPR, CCPA, and other applicable laws through SCCs (Standard Contractual Clauses) or equivalent mechanisms.
     

7.3 Image Storage

  • Images uploaded to the App are stored on your device and, if synced, on secure cloud servers.

  • Images of children (e.g., photocards) require parental consent under COPPA, GDPR, LGPD, PIPL, or DPDP.

  • We use encryption and security measures to protect stored images, per ISO 27001 standards where applicable.
     

8. Service Availability

  • We strive to maintain reliable App performance, but temporary outages may occur for maintenance or updates.

  • We do not guarantee 100% uptime or uninterrupted access.

  • Features may be modified, updated, or discontinued with notice.

  • The App requires:

    • A compatible mobile device with camera access.

    • An internet connection for most features.

    • Sufficient storage space for ticket images.
       

9. Children’s Use

  • Age Restrictions: Users under 16 (or the local age of consent, e.g., 13 in the U.S. under COPPA, 18 in India under DPDP) must provide verifiable parental consent to use the App or store images.

  • Parental Controls: Parents may review, modify, or delete their child’s data by contacting support@ticketeria.co.

  • Transport Photocards: If the App stores images for transport photocards (e.g., similar to TfWM’s Swift Child Photocard), we comply with GDPR, COPPA, or local laws requiring parental consent and secure data handling.

  • We implement age verification mechanisms to ensure compliance with GDPR, COPPA, LGPD, PIPL, and DPDP.
     

10. Limitation of Liability

  • The App is provided “as-is” without warranties of any kind, express or implied.

  • Ticketeria is not liable for:

    • Lost, corrupted, or deleted ticket data or images.

    • Missed events due to App errors or inaccuracies.

    • Damages arising from third-party services or unauthorized access.

  • Our liability is limited to the fullest extent permitted by law, including under Georgia State Law or applicable local regulations.
     

11. Indemnification

You agree to indemnify and hold Ticketeria, its affiliates, and employees harmless from any claims, damages, or expenses arising from:

  • Your use of the App.

  • Your violation of these Terms or applicable laws (e.g., GDPR, CCPA, CSAM regulations).

  • Your infringement of third-party rights (e.g., uploading unauthorized ticket images).

  • Content you upload, including illicit materials.
     

12. Termination
 

12.1 Your Rights

  • You may delete your account or stop using the App at any time.

  • Account deletion requests can be submitted to support@ticketeria.co. Data will be removed within 30 days, subject to legal obligations.
     

12.2 Our Rights

  • We may suspend or terminate your account for violations of these Terms, including uploading prohibited content (e.g., CSAM, explicit material).

  • We may remove content that violates GDPR, CCPA, DSA, or other laws.

  • We reserve the right to discontinue the App with reasonable notice.
     

13. Updates and Changes

  • Terms Updates: We may revise these Terms periodically. Material changes will be notified in-app or via email. Continued use constitutes acceptance of updated Terms.

  • App Updates: We may release updates with new features or security enhancements. Some updates may be mandatory for continued use.

  • Check for updates regularly via the App or our website.
     

14. Geographic Restrictions

  • The App is available worldwide where permitted by law.

  • Some features may be restricted in certain regions due to local regulations (e.g., PIPL data localization in China).

  • You are responsible for ensuring compliance with local laws, including export restrictions.
     

15. Governing Law

  • These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

  • Any disputes will be resolved in the state or federal courts of Georgia, unless local law mandates otherwise (e.g., GDPR consumer protections in the EU).
     

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
 

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ticketeria regarding the App.
